Federal Way DUI Attorney
If you are arrested or charged with DUI, other alcohol-related driving offense, or misdemeanor offense in Federal Way, you will either be booked into jail or released. If booked, you may have the opportunity to post bail, either directly or through a bonding agency. If you remain in custody, you should appear before the Federal Way judge within 24 hours excluding weekends and holidays. If released, the officer may give you a date to appear in court or inform you that you will receive a court date in the mail.
At your first Federal Way court appearance, known as the “arraignment,” the prosecutor will ask the court to set conditions of release, which will depend on several factors including the alleged facts of your case, your prior DUI or other criminal history, ties to the community, and prior history of failing to appear in court. In Federal Way, you will likely appear for arraignment one business day following your arrest whether you are still in custody or not. Conditions of release may include bail, electronic home monitoring, or alcohol monitoring devices such as SCRAM or an ignition interlock device. In Federal Way one of two judges will likely hear the allegations and impose those conditions. Your arraignment may be your only opportunity to challenge the prosecutor’s basis for requesting release conditions, or to make decisions regarding judges that may potentially handle your case. A DUI defense attorney familiar with the customs and practices of the Federal Way court and its prosecutors is your best defense at this critical time. Federal Way DUI Criminal Attorney Dan Gerl served as a Federal Way Prosecutor for two years and currently represents clients there on a regular basis.
It is critical that you contact an experienced Federal Way DUI criminal attorney as soon as possible after being arrested, even if you do not yet have a court date.
