Facts Regarding a Traffic Stop
Most arrests for DUI occur in the context of a traffic stop. In order to legally stop a driver, an officer must have a reasonable suspicion that the driver committed an infraction (i.e., speeding, failure to yield, equipment violation) or is engaged in criminal activity. If you are stopped by a police officer, carefully and safely pull to the side of the road. Roll down the window, stay seated, and retrieve the requested documents. Be polite. The less you say, the better. Do not exit the vehicle prior to being asked, as this will only escalate the situation. Remember to remain polite, calm and courteous throughout the entire process. Politely decline any roadside testing or questioning, and ask to speak with an attorney. Renew this request if necessary upon arrival at the police station.
